November 1, 2010 At a case conference held October 19, 2010, the parties agreed to the following timetable:
The defendants will file their record by February 28, 2011. The plaintiff will file any reply material by April 30, 2011. Cross-Examinations are to be completed by July 8, 2011. Any follow-up matters from cross-examinations are to be completed by July 29, 2011. The plaintiff's factum on certification is to be filed by August 26, 2011. The defendants' factum on certification is to be filed by September 9, 2011. The certification hearing will take place on September 20 and 21, 2011.
October 4, 2010 Counsel for Lorne Waldman has served and filed its certification record, that is, documents to persuade the court that the case should proceed as a class action. The record contains an affidavit from Lorne Waldman, the representative plaintiff, appending marketing material disseminated by the defendants inviting subscribers of the Litigator Service to “get a head start” on their own research by using the copyrighted materials of other Lawyers. The record also contains a proposed plan of litigation for the advancement of the class proceeding, as well as the common issues that the plaintiff submits should be tried together. The parties will attend before the Honourable Justice Paul Perell on October 19 for a case conference to schedule the defendants’ deadline for filing responding material, as well as the date for arguing the certification motion.
